Assignments

Disposing or acquiring an existing lease of a property is known as an assignment and offers a differing degree of complexity for a client as all the lease terms including rent are already on going and are unchangeable.

For the party looking to dispose the lease, the assignor, it may have to accept the rent payable under the lease is higher than current market rental value, which will have an effect on the property’s desirability. In contrast, the existing rent could be less than current market value. In either case, we will provide expert advice on how best to manage this issue.

For the party looking to acquire an existing lease, the assignee, it may have to accept that the existing lease terms are unfavourable and that out of lease contract negotiations are required with the assignor in order to reach a mutually convenient conclusion, for example, reinstatement obligations at the end of the lease.
